1. Agreement Overview
These Terms and Conditions outline the legal agreement between Somify Destination Tours and you as a client. By making a booking or participating in any tour organized by us, you agree to be bound by these Terms and Conditions, including any future updates. Our tours are designed to follow Bhutan’s tourism policies, and we are authorized by the Department of Tourism in Bhutan to provide tour services. Any additional terms or instructions specific to individual tours will also apply.
2. Booking and Payment Policy
Bookings can be made through our official website, authorized agents, or directly via email.
- To confirm your booking, a non-refundable deposit of 10% of the total tour price must be paid within 10 days of the booking request.
- The remaining balance must be paid no later than 21 days before the tour start date.
- If the booking is made within 21 days of departure, full payment is required at the time of booking.
- Failure to complete payment within the specified timelines will result in automatic cancellation of the booking. All payments are to be made in US dollars.
3. Cancellation and Refund Policy
If you need to cancel your booking, please notify us in writing. Refunds will be calculated based on the following conditions:
- Cancellations 30 days or more before the departure date: 100% refund of tour price, minus the non-refundable deposit.
- Cancellations between 15 – 29 days before the departure date: 75% refund of the tour price.
- Cancellations between 04 – 14 days before the departure date:50% refund of the tour price.
- Cancellations between 02 -03 days before the departure date: 25% refund of the tour price.
- Cancellations within 24 hours or less before departure: No refund.
- For changes in tour dates, an administrative fee of $100 applies, subject to availability. Refunds will exclude Bhutan’s mandatory Visa Fee (US $40), any government fees, and bank transfer charges.
4. Liability Disclaimer
We shall not be liable for any injury, loss, delay, or inconvenience arising from factors beyond our control, such as natural disasters, acts of government, strikes, civil disturbances, or delays due to travel logistics within Bhutan. While we aim to provide a safe and enjoyable experience, clients must recognize that Bhutan’s terrain, weather, and infrastructure can be challenging. Clients are responsible for assessing their physical fitness and suitability for the tour activities they have selected. Clients are encouraged to consider comprehensive travel insurance to cover unforeseen events.
5. Client Responsibilities
Each traveller must have a valid passport with at least 6 months of remaining validity from the return date. Bhutan requires a visa, which we will arrange, but we are not responsible for incorrect or delayed issuance due to inaccurate client information. Clients are expected to abide by local Bhutanese customs and laws, including prohibitions on smoking in public places, littering, and strict wildlife protection laws. Failure to comply with these rules or repeated disruptive behaviour may result in removal from the tour without a refund, and local authorities may be notified.
6. Changes to Itinerary or Services
We strive to adhere to the confirmed itinerary; however, due to weather, road conditions, or government regulations may necessitate modifications. In the case of significant itinerary changes, we will do our utmost to provide comparable alternatives. Any cost differences arising from such changes (e.g., additional nights of accommodation or alternative transportation) will be the responsibility of the client. If changes impact government-regulated fees or permits, we will work to secure a refund where applicable but cannot guarantee full reimbursement.
7. Travel Insurance Requirement
Though it’s not mandatory; however, we strongly recommend all clients purchase travel insurance that covers medical expenses, emergency medical evacuation, trip cancellation, and personal liability. Adventure activities, such as trekking, mountain biking, and high-altitude hiking, require additional coverage. In case of an emergency, Bhutan’s mountainous terrain may require specialized evacuation, which can be costly. We cannot cover these expenses on your behalf.
8. Use of Personal Data
We collect and process your personal information, such as passport details, contact information, and travel preferences, to secure permits, book accommodations, and provide seamless tour experiences. This data is securely stored and shared only with authorized third-party suppliers directly involved in your tour arrangements. In compliance with data protection regulations, we ensure that all personal information is handled with care and confidentiality. You may request access to or deletion of your data by contacting us via email, although some information may be retained for legal or administrative reasons.
9. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of Bhutan. In the event of any dispute arising from this agreement, both parties agree to attempt to resolve the issue through negotiation. If a resolution cannot be reached, the matter shall be settled by arbitration under Bhutanese jurisdiction. Any claims must be submitted within 3 months of the incident giving rise to the claim.
10. Additional Provisions
Health and Safety Requirements:
- Clients must disclose any pre-existing health conditions that may impact their ability to participate in the tour. We reserve the right to decline bookings from individuals who may not be suited for physically demanding activities without adequate preparation. Clients are responsible for consulting with their healthcare provider regarding any vaccinations or medications recommended for Bhutan.
Luggage Limitations:
- Due to limited vehicle space and portage services, clients are limited to one piece of checked luggage not exceeding 30kgs and one small carry-on item. Excess baggage is the responsibility of the client and may incur additional charges or require alternative transport arrangements.
